Fathers are for more than sending money

By The Tennessean 3/23/2010

"The Tennessee General Assembly is considering legislation (HB2916) whereby children would have joint parenting by their divorcing parents. Believe it or not, women's groups, lawyers and "child advocates" oppose this legislation. Creating a child equally takes a man and a woman. Parenting should also equally take a man and a woman. What's wrong with that logic?"

Losing everything...

By Emanuel Cavallaro Springfield News Sun - Ohio 4/26/2009

"Four years ago, when Jamie Bowshier came home from Iraq, he had everything he wanted in life: A wife, three kids, a job, a house. A promising future. When he returned to his house on Seymour Street, he found that neighbors had lined the street with American Flags and tied red, white and blue balloons to the stop signs. ...Bowshier, 34, is now divorced and has lost custody of his three children. His kitchen countertop is lined with a month’s worth of mail, most of it bad news: late notices, Veterans’ Affairs documents, bills he can’t afford to pay. But things were going bad even before that. After the divorce late last year, he withdrew money from his 401(k) to catch up on his bills. Soon after, his paychecks were garnished for child support payments. His child support obligation was later reduced by about $200 when his ex-wife started working. But by that time, he was so far behind it seemed impossible to catch up."

Child-support agency asked for man's motorized bar stool

By SETH ROY • Newark Advocate • 6/18/2009

"Negotiations between Wygle and Ripley Entertainment Inc. broke down after Licking County Child Support Enforcement Agency asked for the stool and any revenue generated from it. Wygle owes $37,066.39 in child support, according to court documents. "It actually sounds pretty goofy to me," said Wygle, who paid $350 for the stool originally. "Now they want to seize my bar stool." When Wygle crashed his contraption - a bar stool welded to a metal frame and powered by a five-horsepower engine - in March, the stool attracted attention from news outlets around the world, and apparently from "Ripley's Believe it or Not." The child-support agency filed a petition after hearing of the possible sale, asking that any proceeds from the bar stool be applied toward due child support."

International child-custody cases spike

By The New Haven Register - CT 6/14/2009

"It was a globe-trotting romance: a handsome American working as a model in Italy falls in love with a Brazilian beauty studying fashion design in Milan. They marry in 1999, settle in the tony New Jersey shore town of Red Bank, and have a son. Four years later, the couple’s relationship begins to change from an international love affair into a diplomatic nightmare. The woman, Bruna Bianchi, took the couple’s son to visit her relatives in Brazil in 2004 but never returned. The boy’s father, David Goldman of Tinton Falls, N.J., has been battling to get his son back ever since. While the Goldman case has been prominent in recent news coverage, it isn’t the only dramatic custody case being fought across international borders. The U.S. State Department says such parental abductions involving American children are rising. There were more than 1,000 new cases of American children taken by a parent to another country last year — a 35 percent increase over 2007, according to the department."

Children's Aid Society workers should be reined in, critics say

By Kevin Libin -- National Post 6/12/2009

"For most of us, they are generally unseen, save for occasional mentions in news reports, when they rescue children from misery. Or, as sometimes happens, deliver it. Canada's child-welfare agencies, says University of Manitoba social work professor Brad McKenzie, have among the broadest intervention powers in the Western world. Caseworkers come armed with vaster powers than any police officer investigating crime. It is an immense authority easily abused, without vigilant restraint. It is time, critics say, they were reined in. "The social worker system, as it applies to children, is out of control, seriously out of control," says Katherine McNeil, a children's advocate who has worked with families in Nova Scotia and B.C. "And nobody's doing anything about it." Child-welfare agencies step in when kids are homeless, exploited, hungry or abused. They do not stop there. As the highly publicized neo-Nazi case in Winnipeg demonstrates, they might seize children from parents for teaching racist views, or for "emotional neglect." They have taken newborns from parents considered insufficiently intelligent; from religious families believing the Bible commands them to discipline kids with a rod. They order homeschooling parents to enroll children in public school, deeming them inadequately socialized."

Girl told police her parents praised Hitler for killing 'lots of people'

By CBSNews.ca 6/5/2009

"An eight-year-old girl at the centre of a controversial child custody battle said she doesn't agree with her parents that ethnic minorities should be killed, but that they should go back to their own countries, a Winnipeg courtroom heard. On Friday, court heard a 40-minute videotaped interview the girl had with police hours after she had been seized by child welfare authorities. Her mother and stepfather, who are accused of racist teachings and failing to provide adequate care for the girl and her brother, began a court battle for their children last week."

Monmouth County father David Goldman returns home from Brazil without son

By NJ.com 6/5/2009

David Goldman, from Tinton Falls, rushed to Rio de Janeiro earlier this week when a federal judge ruled that he should have custody of 9-year-old Sean. But the Brazilian Supreme Court later said it would review the decision and put off a handover. That court is scheduled to make some kind of ruling Wednesday. Goldman's wife, Bruna Bianchi, took the boy to her native Brazil in 2004. She died last year in childbirth, and the boy has been living with his mother's new husband."

His defense lawyers say he is mentally ill and therefore not responsible for his actions. ...Denner said that when his wife filed for divorce and he later lost of his daughter, it was "the perfect storm that sent him over the edge." Make parent account for support payments

By Pocono Record - Pennsylvania / Letter to the editor 5/21/2009

"A friend of mine from New York State who pays child support told me that the state is in the process of instituting a program in which money that is paid for child support goes to a debit/credit card instead of the mother's savings or checking account. This is a great idea. Credit cards leave paper trails and this way if a father makes child support payments, the mother will be "expected" to use the money entirely for the child and not on supplementing her wardrobe, paying her bills or buying home furnishings."

Support group looks to help noncustodial parents

By Iowa City Press-Citizen • 5/5/2009

"Matt Hills thought he was alone in his frustration about the custody battle over his son. At first, he was angry and wanted to fight the decision that put his son in the mother's care. But, "after a year or two of fighting, you're dejected," said Hills, who lives in West Branch. In 2006, Hills found IowaFathers.com, a support group that has a message board and resources online and also hosts monthly or more frequent meetings. Hills started a group meeting in the Iowa City/Coralville area in April. When his custody case was heard, the judge made a ruling without giving Hills a chance to speak, he said. "My case was not unlike others," Hills said. "I was influenced by the system -- by law enforcement, by attorneys, by judges." Hills said a social stigma and stereotype exists about noncustodial parents. "Most of the ones I meet want to spend time with their children," he said."

Couple says state, woman illegally took child support

By Justin Anderson-Kanawha Bureau -- West Virginia Record – West Virginia 4/30/2009

"A couple says the state and federal government is continuing to take child support payments from them even after the female half of the couple regained custody of her child. Christian and Angela Lindroth filed a lawsuit April 15 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources, Tamicka Tolliver, a DHHR employee, Policy Studies, a company contracted to collect child support for the state, and Debbie McMillan, a woman who had temporary custody of Angela's daughter.
According to the complaint, a Kanawha Circuit judge ordered Angela to pay $50 a month in child support. The state on July 2006 notified Angela that her wages would be garnished, but the plaintiffs claim no money was ever taken out of her paycheck. In March 2007, Angela was told she owed $411 in child support that was in arrears. The plaintiffs claim Angela paid the amount in full and regained custody of her daughter days later. Following that alleged payment, the plaintiffs contend that four payments were taken from Angela's wages after regaining custody. Then, in 2008, $185 was taken out of Angela's income tax return for child support, the complaint says. The plaintiffs say that McMillan knew she was not entitled to the payments anymore, but continued to take the money."

Dad denied right to be proper parent

By Mindelle Jacobs --The Beacon Herald - Canada 4/30/2009

"This is the tragedy of a messed up mom who couldn't parent, a stable dad who wanted to but was overlooked and a troubled child who's been raised by the state. Some men don't want anything to do with the children they've fathered. Others, like David, do but end up shut out of their kids' lives because of hostile ex-partners, government bureaucracy and legal fees that sap their spirits as well as their bank accounts. I'd like to identify David (not his real name) but I can't because his daughter, almost 17, is in foster care in B.C. She has been a permanent ward of the state since age 8, when she was removed from her unfit mother's care. When a child is taken into protective custody, both parents are supposed to be served with court papers. Somehow, David, 44, an Edmonton computer systems analyst, was never contacted. So a father who'd been looking for his daughter for 15 years was denied the right to parent and a child who had often wondered about her dad grew up angry and suicidal in state care."

Put families first, one father at a time

Giving parents equal parenting time by law

By Bill Harrington --  Editorial -- The Seattle Times 2/25/2009

"For the third time in 22 years, Washington state is leading the nation in family law reform. This time, the report is called the Residential Time Summary Report prepared by the state Office of the Administrator for the Courts. This is a first-in-the-nation compilation of post-divorce breakdown of parenting time for children, mothers and fathers. The numbers are collected case-by-case and county-by-county. Amazingly, 46 percent of children of divorce, statewide, are ordered to spend a minimum of 35 percent parenting time with their biological fathers. Parenting time is broken down by large percentages, and meaningful shared parenting starts in the range of 30-35 percent."

Innocent Marine freed after 9 years in prison

By Gidget Fuentes - Marine Times 4/20/2009

"A decade ago, while serving as a military police officer at Camp Pendleton, Calif., Foster told his company commander that he would refuse nonjudicial punishment over allegations made by his estranged wife accusing him of raping her in 1995 and assaulting her from 1994 to 1998. Her rape claim surfaced amid a bitter divorce and custody fight over their two young sons. Foster, now 35, figured he’d be acquitted at court-martial, where he was charged with rape, aggravated assault and making threats. What Foster didn’t know was that about 90 percent of all general courts-martial end in convictions, either from the jury or through plea agreements, according to annual reports from the Navy’s Judge Advocate General. He also didn’t count on a shoddy defense and prosecution, which convinced a jury to sentence him to 17 years in prison, bust him to private and cap it all with a dishonorable discharge.

Bosh's evidence contradicts ex-girlfriend's version

By Joe O'Connor - National Post 3/27/2009

"...Mathis's court filings painted Bosh as just another deadbeat millionaire athlete father. He had planned to marry her, Mathis alleged, before attempting to have her removed from their shared residence in Texas, cutting off her access to a vehicle, and cutting off the money supply when she and Bosh's unborn child needed it most. Broke and abandoned, physically ill and emotionally distraught, Mathis moved home to her mother in Maryland where the baby was delivered by emergency Caesarean section on Nov. 2. ...In the affidavit - which appears to give more details of their breakup than were contained in the original lawsuit - Bosh contends that he did not "take any actions to have [Mathis] removed" from the property the couple shared in Frisco, Tex. He claims he "encouraged" Mathis to remain in Texas and was "hopeful that she would." He paid for a Jeep Grand Cherokee "rental vehicle" in the final weeks of the pregnancy, provided money for "expenses" and made "arrangements to include my daughter on my health insurance coverage. "In fact, the majority of my daughter's pre-natal and post-natal expenses have been paid by my insurance carrier or by me," Bosh said in the document. Bosh also states that he has sent Mathis monthly cheques to support Trinity, but says that Mathis has not cashed them. ..."

Funding a child custody case: Attorney’s fees are only part of it.

By Examiner.com - USA 3/19/2009

"A hotly contested child custody case in Harris County is likely to rack up some hefty attorney’s fees.  No surprise there.  Not everyone has the ready funds to match an attorney’s retainer demands in such cases.
Often, waiting to save up for a retainer is not an option.  Either you have been served a petition and have a short time to respond, or you learn of a situation that requires fast legal action to assure the well-being of the child. You manage to pull it together from a variety of sources, at least enough to get things started. At least now you have some breathing room, right?  Maybe."

Curry gets custody of son

Rushing: Parents need fairness in hard times

- Guest Columnist -- The State – South Carolina 3/16/2009
"For many years, the courts have operated with an undeniable yet unspoken presumption that the non-custodial parent who fails to pay his or her child support obligation is somehow at fault, and deserving of punishment. There’s even a popular term for these folks: deadbeat dad. This is often a fair assessment, but not always. Non-custodial parents frequently lose the ability to pay through circumstances beyond their control, yet their explanations are treated with skepticism or even indifference. This might be excusable in a strong economy, when the non-custodial parent has real options when he or she is essentially told to find a job or go to jail."

A Civil Rights Champion Dies

By MarketWatch (press release) - USA 3/4/2009

"We have just lost a champion of civil rights. James Cook, often called the "father of joint custody," passed away last week in California. His passing is being lamented by prominent fathers' rights attorney Jeffery Leving. ....James Cook's effort has forever changed the treatment of fathers in the courts. When James Cook went through the trauma of divorce, there were no civil rights for fathers. The judge told him that the law did not permit him to grant joint custody. In contrast, about a decade later, New York Supreme Court Judge Richard Lattner regarded joint custody as "an appealing concept" that freed the court from making decisions based on gender. ..."

The Great Custody & Child Support Scam

By Jake Morphonios  Nolan Chart - Virginia 2/24/2009
