Court finds convicts have no right to test DNA

"The Supreme Court said Thursday that convicts have no constitutional right to test DNA evidence in hopes of proving their innocence long after they were found guilty of a crime. The decision may have limited impact because the federal government and 47 states already have laws that allow convicts some access to genetic evidence. Testing so far has led to the exoneration of 240 people who had been found guilty of murder, rape and other violent crimes, according to the Innocence Project. The court ruled 5-4, with its conservative justices in the majority, against an Alaska man who was convicted in a brutal attack on a prostitute 16 years ago. William Osborne won a federal appeals court ruling granting him access to a blue condom that was used during the attack. Osborne argued that testing its contents would firmly establish his innocence or guilt. In parole proceedings, however, Osborne has admitted his guilt in a separate bid for release from prison. The high court reversed the ruling by the 9th U.S. Circuit Court of Appeals in San Francisco. States already are dealing with the challenges and opportunities presented by advances in genetic testing, Chief Justice John Roberts said in his majority opinion."

"The celebration of Father's Day allows our nation a moment to pause and reflect on the memories and experiences of childhood and fatherhood alike. Aside from the typical gift selection of a new tie, putter or power tools, no serious consideration is given to this holiday. This Father's Day, take a break from the barbecue grill, playing catch or listening to another one of dad's widely exaggerated stories (that you've already heard at least a thousand times), and ponder a more broad subject, the rights of a father. A father's rights have remained a largely hidden issue, tucked away beneath America's fiery and passionate opinions on abortion. In many ways, the parental rights of expectant fathers are blatantly ignored, and fathers are, in a court of law, unable to voice their opinion in regard to childbirth. A fundamental assumption leading to the Supreme Court's decision in Roe v. Wade was that because women are biologically tied to the birth process, they should therefore bear all responsibility in deciding the life or death of their children. The reason for this perspective is straightforward: Roe v. Wade rejected the idea that another person controlled a woman's body. ....We live in an age of eroding family values, in which fathers routinely abandon their children and disregard their familial responsibilities. Mr. Stachokus' desire to raise and care responsibly for his child should be commended and encouraged. Instead, the law brutally and arbitrarily denies that he has any right to his child whatsoever. Countless men are faced with the same nightmare of having no voice in the execution of their children. "Men's rights are trampled on all the time when it comes to reproductive rights," said Dianna Thompson, executive director of the American Coalition for Fathers and Children. It is time to fight back, to force our government to re-evaluate the logic of treating men as little more than fertilizers. ..."

Woman says NFL veteran Travis Henry fathered twins, owes money

"Travis Henry made millions of dollars playing in the NFL. He has also made a lot of babies. The 30-year-old Polk County native publicly acknowledges he has nine children — with different mothers — but a Central Florida woman says that's not so. The number, she says, should be 11. Vanessa Colbert recently became the second woman in Orange County to try to collect child support from Henry. She says the former athlete fathered her twins, who are now 18 months old. Henry hasn't been ordered to pay support to Colbert or to the other woman, Dorothy Michelle Maloy, who did not return calls. But in Polk County, he owes more than $11,000 in back support in two cases. The Orange County women have joined a long line of mothers seeking money from the man who once played for the Denver Broncos, Tennesee Titans and Buffalo Bills."

"Non-custodial parents feel just as frustrated with the child support system as the custodial parents who don’t receive payment. Brandon Fossett waited over a year before the courts determined his son’s paternity. During that year, he spent time with the mother and child, and he said he helped however he could. He was reassured by the courts that he did not owe support and wouldn’t have to pay back support when paternity was determined; however, when the paternity test proved he was the father, he was hit with more than $2,000 in back support. Fossett, who was going through a period of homelessness at that time, was unable to come up with the money. He said that is when he got a true look at how the system treats non-custodial parents, even those like him who make regular payments each week. “I just wish there was a little more respect out of the judicial system for the people who are trying,” said Fossett.
He said the courts made it harder for him to find a job when he was unemployed because he was forced to have potential employers sign forms saying he had interviewed for the position. Then he would have to take off numerous times to attend court.“I have been kept in court for a long time, and every time I go in, I tell them I am paying support. Then they tell me to leave,” said Fossett."

"Sitting recently in the Rowan County courtroom waiting to hear the cases on paternity and child support, I was struck by the overflow of cases, the youth and unemployment of the parents in question and the unfairness of this system to children as well as taxpayers. Men should be outraged that they can be challenged for paternity with or without cause, without rights of recovery, even when they are not proven the father of the child in question. And taxpayers are being fleeced to support children for whom the parents often show little regard or responsibility in their conception and care. A young friend of mine was told by his then girlfriend that she was pregnant and he was the father. Raised to be responsible and believing he was the only one involved with the potential mother, he contributed more than $8,000 to the care and nurturing of the child, disregarding the admonition of his mother and me to get a paternity test. When he did finally get the DNA paternity test, it proved he was not the father of the child. He was stuck with a bill for a child he didn't create and no penalty accrued for such falsification by his accusers — the mother and DFCS. Where is equal justice? On the court docket were several young men being brought up for non-support of more than one child involving more than one woman. There seemed to be no sense of shame in the courtroom. One young man started shouting and cursing at his girlfriend until I intervened and told him to cool it. Several young women had more than one child by different men."

Make-believe marriage consequences are real

There is likewise no basis for claiming separate maintenance when the live-in arrangement is terminated. (In other jurisdictions separate maintenance might be called alimony). Without marriage, one partner might not have any say in how the other partner is treated in case of disability nor even be able to visit their partner in the hospital. Without marriage, there is little or no basis for listing the other partner on employer health plans nor for claims to share in retirement benefits.
Neither would the lack of a marriage ceremony free Nathan from parental responsibilities in the event children were born to the live-in arrangement. The courts can order DNA testing to establish paternity and then order paternal monetary support of the children. Only 11 states and the District of Columbia recognize common law marriage."

Barrie woman seeks child support from Keanu Reeves

"A Barrie woman has filed a request to an Ontario court to compel actor Keanu Reeves to provide a DNA sample as part of a bid to get support for herself and her four children. Karen Sala, 46, who is acting as her own lawyer, filed notice on Monday in the Superior Court of Justice family branch. Legal papers were served on Reeves' business manager in Los Angeles two days ago. The first court date for the case is July 6 in Barrie. "I'm pissed. I just want him to stand up and be a man," Sala said in an interview yesterday. A spokesperson for the actor said Reeves denies even knowing Sala and strongly rejects her claims. None of the allegations have been proven in court. ....In addition to the DNA test, Sala is seeking child support of $150,000 per month, retroactive to June 1988, as well as $3 million per month in spousal support retroactive to November 2006."

"Good news seems hard to come by in Jamaica these days, but not so this past week. In the space of two days, the government launched the Ananda Alert Child Abduction System, and Parliament moved to adopt the motion that the names of fathers will be placed on the birth certificates of their children. Member of Parliament Ronnie Thwaites must be congratulated for his instrumentality and perseverance in introducing and shepherding the bill to legalise paternity. Mandatory registration of fathers has been long overdue. Ensuring that a child at birth is afforded the names of both his mother and father, is, as far as I am concerned, an inalienable right. After all, this is not slavery where children were denied their biological identity and were forced to take on the slave owners' last names. A friend of mine keeps reminding me that even pedigree dogs have birth certificates with the names of both parents. In fact, even the names of their grandparents. The question she asks is, if the dogs have it, why not our children? The mandatory registration of fathers is an important first step in what I hope will be a structured and systematic programme of family life reconstruction and restoration in this country."

On child support: Let’s make sure we’ve got the right guy

"It may be rare in the state of Missouri, but it does happen. Every payday, some guy has a few hundred dollars deducted from his wages and that money goes to support a child that’s not his. If you’re that guy, you pay because the courts have so ordered. You keep paying because if you fall behind, you will be charged with criminal nonsupport and might do some jail time. At this point, your future is dim. And, there’s nothing you can do about your situation. The Missouri General Assembly moved to remedy these situations this past session. One of the bills it passed would allow men to challenge paternity with a DNA test. If they’re not the father, they would be excused from all past-due child support and any future support. They also would have their names removed from a birth certificate and have past criminal convictions for nonsupport expunged from their record. The bill is lying on Gov. Jay Nixon’s desk. His office says he wants to study the issue before signing it. So guys, if Mr. Nixon signs the legislation and if you believe you’re wrongly paying child support, you have until Dec. 31, 2011, to file a petition contesting your paternity."

Texas woman gives birth to twins - from different fathers

"The 11-month-old twin boys born to a Texas mom have a lot in common, but one thing they don’t share is a father. That’s because their mother, Mia Washington, cheated on her partner, James Harrison, according to the Daily Mail, and her fling resulted in a one-in-a-million double conception. The result is that one twin, Jordan, is James’s son but the other one, Justin, was fathered by a man whose identity has not been released. The Dallas mother became suspicious about her sons’ paternity when she realized that their facial features were dissimilar, according to the Daily Mail. She visited Clear Diagnostics DNA Lab, had a paternity test, and learned that there was just a 0.001 chance that the twins could have the same father.
“I have twins who have different dads,” the mom told the newspaper. “Out of all the people in America and all the people in the world, this had to happen to me.”

"If you’re a deadbeat dad who agrees to start making child support payments to stay out of jail, you’ve got to meet one more requirement in Judge Wade McCree’s Detroit courtroom: Watch the Maury Povich show. McCree, a criminal judge in Wayne County Circuit Court, has begun sentencing dads to watch the show as part of their probation. The judge, who will appear on the show Thursday, said he got the idea after watching a few episodes. One day in February he shouted to a man with five kids from five mothers: “What the hell do you think this is, the Maury Povich show?” “Everyone fell out laughing, but it really wasn’t funny,” the judge said today. A videographer was in the courtroom for a local TV show and asked permission to send the clip to Povich’s show, McCree said. Soon, Maury had a crew filming in McCree’s courtroom and they invited him in for a show taping last month. “Some of these men in my court watch the show and see how ridiculous some of the deadbeats look, and then they realize it’s them,” McCree said. Povich’s shows often focus on paternity issues, DNA testing and child support."

Pa. counties sued in mistaken child-support case

Ore. babies switched at birth meet 56 years later

"On a spring day in 1953, two babies were born at Pioneer Memorial Hospital in the Eastern Oregon town of Heppner — DeeAnn Angell of Fossil and Kay Rene Reed of Condon. The girls would grow up, get married, have kids of their own and become grandparents. Then, last summer, Kay Rene's brother, Bobby Reed, got a call from an 86-year-old woman who had known his mother and had also lived next door to the Angell family in Fossil. "She said she had something she had to get off her chest," Bobby Reed said in an interview with the East Oregonian newspaper of Pendleton, which reported the story Sunday. Bobby met the woman at the nursing home where she lives. The woman said Marjorie Angell insisted back in 1953 that she had been given the wrong baby after the nurses returned from bathing them. Her concerns, however, were brushed off. Then the old lady showed Bobby an old photo. "It looked like Kay Rene in about 7th or 8th grade," Bobby said."

"A Philadelphia man who was thrown in Dauphin County Prison four times for not paying support for someone else's child has filed a federal lawsuit against the county and Montgomery County, charging that officials tampered with his personal information to make him appear to be the father. The lawsuit filed in U.S. Middle District Court by Walter Andre Sharpe comes on the heels of Dauphin County District Attorney Edward M. Marsico Jr. saying no criminal charges would be filed in the case. The lawsuit says domestic relations officials in Montgomery County changed Sharpe's name in their computer system because he at one time used his mother's maiden name. His Attorney, Spero Lappas said he could find no explanation in the records for why his date of birth and other identifying information was changed to match up with Andre Sharpe, the real father of the child."

States move to allow DNA paternity challenges

"JEFFERSON CITY, Mo. — James McClendon knows he's not the biological father of his ex-girlfriend's 16-year-old son. He's got a DNA test to prove it. But his wages are trimmed each month to pay thousands in child support debt. McClendon, who lives in St. Louis, has been fighting a 10-year legal battle to overturn a paternity ruling that says he's the child's father. Between legal bills, supporting his three biological children and several failed jobs, he's built up $25,000 in child support debt. I'm not the kid's father. Why am I still being prosecuted for this?" said McClendon, 36. "How can I go on with my life with that type of debt?"

 

Stories like McClendon's have inspired more than 30 states to adopt laws in the past decade allowing men to challenge paternity rulings with genetic tests, which can achieve nearly total accuracy. At least nine states this year are considering legislation to either allow DNA paternity challenges or expand them. Missouri could become the latest state to join the trend. A bill pending Gov. Jay Nixon's signature would give men two years to contest paternity rulings with a DNA test. A spokesman for the governor said he plans to review the bill after the legislative session ends May 15."

Dauphin County DA will not file charges in mistaken identity child support case

Marsico Jr. says his office will not be filing criminal charges in a mix-up that landed a Philadelphia man in jail four times for not paying child support for someone else's child. Marsico said his investigation, ordered by President Judge Richard A. Lewis after The Patriot-News reported on the situation, revealed that a "screw up" occurred in Montgomery County, but did not involve any criminal intent. That mistake left Walter Andre Sharpe Jr. of Philadelphia forced to pay $12,000 in support for another man's child and thrown in Dauphin County Prison four times for not keeping up with the payments. It took The Patriot-News less than a hour to find the real father, who said he had custody of the child Sharpe had been supporting. Sharpe was paying support to the child's mother and then her grandmother."

Biological fathers win first round in fight for parental rights

"Based on current Kentucky law, not all biological fathers have the right to be in their child's life. It can be a very complicated story, but some say it is a simple fix - just change the law. Rep. Darryl Owens is one of the sponsors of a bill in the Kentucky Legislature to do just that because he believes it is time to right that wrong. ....Rhoades stood before lawmakers, along with other Kentucky fathers who have similar stories, to plead for House Bill 28 to be passed. It is the help they need to see their children who were conceived during an alleged affair with a married woman. Even after DNA testing proves their paternity, these fathers have no rights by law."

"A DNA test will be performed to determine if a 13-year-old boy fathered a baby with his 15-year-old girlfriend, his spokesman said Monday. ....The test comes after a Sunday tabloid newspaper reported that other teenage boys have come forward claiming to be the father of the newborn baby girl."
